Version 1.1 — In force as of 10 September 2026
These General Terms and Conditions of Use and Sale (hereinafter the "Terms" or "GTCU/GTCS") govern the use of the Youmiamiam mobile application (hereinafter the "Application" or the "Service").
Before any use of the Application, read these Terms carefully. By using the Application, you acknowledge that you have read, understood and accepted them without reservation. If you do not agree with any of these clauses, do not use the Application.
These Terms are accessible at any time from the Application (Profile › Legal documents section) and online at https://youmiamiam.be/documents.
Language of this document. This English version is an automatic translation produced by an artificial-intelligence tool, provided solely for your convenience. Only the French-language versions of these Terms and of the Privacy Policy have legal force. In the event of any divergence, ambiguity or contradiction between this translation and the French version, the French version prevails. The French documents remain available at https://youmiamiam.be/documents.

You are solely responsible for the content you submit to the Application and you undertake to respect the rights of third parties, under the conditions set out in Article 7.1.
Youmiamiam carries out no general monitoring of the content submitted and acts as a technical service provider on the explicit instruction of the user.

3. Acceptance, proof and modification of the Terms
3.1 Acceptance
Use of the Application entails full and unreserved acceptance of these Terms as well as the Privacy Policy, which forms an integral part thereof.
- Users creating an Account: acceptance takes place at registration, by means of a checkbox unticked by default, accompanied by a link allowing both documents to be consulted in full before validation.
- Users in guest mode: acceptance takes place on first launch of the Application, under the same terms.
3.2 Proof of acceptance
For users with an Account, the Publisher records in its database, for evidentiary purposes, the version number of the documents accepted together with the date and time of that acceptance. This record is kept for 5 years after the end of the contractual relationship, in accordance with the Privacy Policy.
Each user may at any time consult, from the Application, the version of the Terms they accepted as well as the version in force.
3.3 Permanent accessibility
These Terms and the Privacy Policy remain accessible at any time and without condition:
- from the Application, Profile › Legal documents section;
- online, at https://youmiamiam.be/documents, including without installing the Application.
3.4 Modification
The Publisher reserves the right to modify the Terms. Any substantial modification is notified to the user via a dedicated screen in the Application on their next connection and requires fresh, explicit acceptance, itself time-stamped and recorded.
Non-substantial modifications (editorial corrections, updating of contact details) take effect on the date indicated at the top of the document.
The version history is available at https://youmiamiam.be/documents.
4. Access conditions — Legal capacity and age
4.1 Minimum age
The Application is accessible to persons aged at least 16. By registering or using the Application in guest mode, you declare that you are 16 years of age or older.
The Application is rated 16+ on the App Store and the Google Play Store. It is neither designed nor intended for children and does not fall within the "Families" programmes of Apple and Google.
The Publisher reserves the right to suspend any Account belonging to a person established to be under 16.
4.2 Legal capacity
You declare that you have the legal capacity to contract under the law of your country of residence. If you are 16 or 17 years old, you declare that you have obtained the prior authorisation of your legal representative, in particular for any paid subscription.
4.3 Professional use
The Application is intended for personal, non-commercial use. Any professional, commercial, automated or mass use is prohibited without the prior written agreement of the Publisher.
5. Description of the Service
5.1 Main features
Youmiamiam allows the user to:
- add a recipe from a video link originating from online platforms (URL pasting or native sharing);
- add a recipe from a photo (cookbook, magazine, handwritten recipe);
- manually create their own recipes;
- edit and organise their recipes;
- share a recipe by means of a secret link viewable in a browser (Article 8);
- synchronise their library across several devices (users with an Account only).
5.2 Three usage tiers
| Action | Guest | Free | Premium |
|---|---|---|---|
| Video link extraction | 10 (lifetime total) | 10/month + tokens | Unlimited |
| Photo extraction | — | 3/month + tokens | Unlimited |
| Recipe editing | ✓ | ✓ | ✓ |
| Sharing by link | ✓ | ✓ | ✓ |
| Recipe deletion | ✓ | ✓ | ✓ |
| Multi-device synchronisation | — | ✓ | ✓ |
| Recipe storage | Local only | Server (France) | Server (France) |
In guest mode, recipes and photos are stored exclusively on the device. Uninstalling the Application results in their permanent and irreversible loss.
5.3 Token system
Tokens are functional units of account internal to the Service. They allow extractions to be carried out beyond the free monthly quota.
Essential characteristics of tokens:
- they are not currency, nor a means of payment, nor electronic money within the meaning of Directive 2009/110/EC and the Belgian Law of 21 December 2009;
- they are strictly personal and non-transferable between users;
- they are not refundable in money or in equivalent goods;
- they are not convertible into physical goods or third-party services;
- they have no value outside the Application;
- they cannot be purchased: they are exclusively granted by the Publisher or obtained in accordance with the terms below.
Obtaining tokens:
- 3 tokens granted at the start of each calendar month for Free users;
- 3 tokens granted upon the voluntary and complete viewing of a rewarded advertising video (AdMob), solely on the user's initiative. The Application displays no imposed advertising: no banner, no interstitial, no advertising content is loaded until the user has explicitly requested to view a rewarded video.
Token cost per extraction:
- Video link extraction: 1 token
- Photo extraction: 3 tokens
Expiry and loss: unused tokens are not carried over beyond the internal technical rules. Deletion of the Account results in the permanent loss of all remaining tokens, without compensation or indemnity.
5.4 Evolution of the Service
The Publisher may change the Service beyond what is necessary to keep it in conformity, for one of the following valid reasons, expressly agreed between the parties:
- adaptation to a technical development, to a new hardware or software environment, or to a change in a third-party service on which the Application depends;
- adaptation to a legal or regulatory development, or to the requirements of the distribution platforms;
- improvement of the security or performance of the Service;
- addition, replacement or withdrawal of features that have become obsolete or unviable.
Such a change entails no additional cost for the user.
Where the change negatively affects access to or use of the Service other than in a minor way, the Publisher informs the user at least 30 days in advance, on a durable medium, stating the date of the change and the right to terminate. The user may then terminate free of charge within 30 days of receiving this information or of the date of the change, whichever is later. In the event of termination, the unused portion of a Premium subscription is refunded pro rata.
6. Account creation and management
6.1 Registration
Registration takes place via:
- a valid email address associated with a password, or
- a third-party identity provider (Sign in with Google, Sign in with Apple).
The user warrants the accuracy of the information provided and undertakes to keep it up to date.
6.2 Account security
The user is responsible for the confidentiality of their credentials. Any action taken from their Account is deemed to have been taken by them, unless proven otherwise. In the event of unauthorised use, the user must inform the Publisher without delay at youmiamiam@tuta.com.
6.3 Guest mode
Guest mode does not create an Account. The user is identified solely by a pseudonymous technical identifier assigned to their device, used exclusively to count the free quota. Consequently:
- no identifying data (email, name) is collected;
- no recipe or photo is stored on the Publisher's servers;
- no multi-device synchronisation is possible;
- uninstalling the Application results in the permanent loss of all local recipes, with no possibility of recovery.
The device identifier is automatically deleted after 1 year of inactivity.
6.4 Account deletion
The user may delete their Account at any time and directly from the Application (Profile section), without any written procedure or justification. The procedure, including for users who no longer have access to the Application, is detailed at https://youmiamiam.be/documents/aide. Deletion results, immediately and irreversibly, in:
- the deletion of all recipes and all associated photos;
- the immediate deactivation of all generated share links;
- the deletion of the Account's identifying information;
- the loss of all unused tokens.
Copies appearing in the encrypted backups are eliminated by rotation within a maximum of 30 days.
Certain data strictly necessary for legal obligations (in particular accounting and tax obligations — 7 years under Belgian law) and the proof of acceptance of these Terms (5 years) are kept separately, in accordance with the Privacy Policy.
Users in guest mode: as no personal data is stored server-side, uninstalling the Application is sufficient to delete all data. The quota identifier automatically expires after 1 year of inactivity.
6.5 Suspension or termination by the Publisher
The Publisher may suspend or terminate an Account in the event of:
- breach of these Terms;
- repeated submission of unlawful or infringing content;
- abusive, fraudulent or improper use of the Service;
- reasoned request from a competent authority or a rights holder;
- failure to pay for a subscription.
Except in cases of urgency, manifest unlawfulness or an order from an authority, the Publisher informs the user in advance of the alleged facts and allows them a reasonable period to remedy them or submit their observations. Any suspension or termination decision is reasoned and may be contested at youmiamiam@tuta.com.
In the event of termination without fault attributable to the user, the unused portion of a Premium subscription is refunded pro rata.
7. User obligations and undertakings
7.1 User's undertaking regarding submitted content
By submitting a link or a photo to the Application, the user declares, with each submission:
- that they are acting on their own initiative, in order to organise their recipes for personal purposes;
- that they are not aware of anything prohibiting them from submitting this content;
- that they are not submitting content from a private or protected space to which they do not have legitimate access;
- that they authorise the Publisher to technically process this content for the sole purpose of extracting a structured recipe from it.
This undertaking is brought to the user's attention when accepting these Terms, recalled in the Application next to the field for adding a link, and remains accessible at any time in these Terms.
7.2 Prohibited uses
The user undertakes not to:
- submit content for which they do not hold the necessary rights or authorisations;
- use the Application for commercial, professional or resale purposes;
- automate, script, scrape or use bots to interact with the Service;
- circumvent quotas, tokens or technical limitations, or manipulate the rewarded-video mechanism;
- submit unlawful, infringing, defamatory, hateful, sexual content or content infringing the rights of third parties;
- submit content from sources requiring authentication of which they are not the holder;
- attempt to access the accounts, data or share links of other users;
- compromise the integrity, security or availability of the Service;
- use the Service in breach of the terms of use of third-party platforms, beyond what is strictly necessary to exercise a legal exception.
7.3 User's liability towards third parties
The user is liable, in accordance with the ordinary law of liability, for the damage they cause to the Publisher or to third parties as a result of:
- a wrongful breach of these Terms;
- the submission of content in breach of third-party rights (copyright, related rights, image rights);
- the public dissemination, via a share link, of content they were not authorised to disseminate;
- an inaccurate undertaking under Article 7.1.
If a third-party claim is addressed to the Publisher as a result of such a breach, the Publisher informs the user without delay and allows them to take part in its defence. The compensation owed by the user is limited to the damage actually suffered, proven and directly caused by their breach.
Clarification: this clause does not derogate from the ordinary law and does not have the effect of imposing on the consumer any flat-rate, automatic or disproportionate compensation. It applies in compliance with the mandatory provisions of Book VI of the Belgian Code of Economic Law relating to unfair terms.
8. Sharing recipes by link
8.1 How it works
The user may generate a share link to one of their recipes. This link allows anyone who has it to view the recipe in a web browser, without installing the Application.
- The link relies on a random, non-guessable identifier.
- The corresponding page is configured not to be indexed by search engines.
- The link is revocable at any time by the user from the Application, and automatically becomes inactive if the recipe or the Account is deleted.
- The page reveals no identifying data about the user (neither email nor name).
8.2 Scope of sharing — essential information
Sharing relates exclusively to the Structured Recipe: title, list of ingredients, quantities, preparation steps, durations, as well as any associated photo and attribution to the source.
The shared page neither reproduces nor makes accessible the source video, its transcription, its original text or any other excerpt of the third-party content. A link to the original source and a mention of its author appear there where this information is available.
The photo displayed on the shared web page is the one provided by the user. Where no photo has been provided, the page may display an illustration loaded directly from the original source or, failing that, a generic illustration. No image originating from a third-party platform is reproduced or hosted by the Publisher for the purposes of this page.
Nature of the shared information: the purely factual information of a cooking recipe — the list of ingredients, the quantities and the sequence of operations — is not, as such, protected by copyright, which protects the original form of expression and not the idea, the method or the factual information. Conversely, reproducing the original wording of a recipe (phrasings, comments, staging, a third party's photographs) may still infringe the rights of its author.
8.3 Liability of the sharing user
By generating a share link, the user goes beyond the scope of strictly private use.
The user accordingly acknowledges that:
- the private copying exception does not cover the dissemination of content to third parties; it therefore cannot be invoked to justify sharing;
- it is their responsibility to ensure that the content they share does not reproduce the original form of expression of a third party without authorisation;
- anyone holding the link can view and forward it: sharing must therefore be restricted to a circle of trusted persons;
- it is their responsibility to revoke the link if they no longer wish the recipe to be accessible.
The Publisher recommends using sharing only for recipes created by the user themselves or for which they hold the rights.
8.4 Removal of a shared page
Anyone who considers that a shared page infringes their rights may report it in accordance with the procedure set out in Article 10.3. The Publisher may deactivate a manifestly unlawful share link, informing the user concerned in accordance with Article 10.5.
9. Licence granted to the Publisher
To enable the provision of the Service, the user grants the Publisher a non-exclusive, worldwide, royalty-free licence, limited to the retention period of the User Content, solely for the following purposes:
- analyse the content designated by the user in order to extract a structured recipe from it (the details of the technical operations are set out in Article 3.2 of the Privacy Policy);
- store the Structured Recipe in the user's personal space;
- display the User Content in the Application, synchronise it across the user's devices and, at their express request, display it on a page accessible via a share link;
- carry out the technical backups necessary for the security of the Service.
This licence does not authorise the Publisher to exploit, publish, commercialise, assign or communicate the User Content for its own purposes, nor to use it to train artificial intelligence models.
The licence terminates automatically upon deletion of the User Content concerned or deletion of the Account.
The user retains full intellectual property over their User Content. The Publisher claims no ownership right over the structured recipes or the submitted content.
10. Status of the Publisher — Technical service provider
10.1 Nature of the Service
The Publisher acts as a neutral technical service provider, carrying out automated operations on the explicit instruction of the user. It has no knowledge of the specific content submitted by each user, carries out no general monitoring within the meaning of Article 8 of Regulation (EU) 2022/2065 (Digital Services Act — DSA), and has no obligation of prior filtering.
The Publisher falls within the category of micro-enterprises within the meaning of Recommendation 2003/361/EC and, on that basis, benefits from the exemption provided for in Article 19 of the DSA for the obligations of Section 3 of Chapter III.
10.2 Limited liability regime
In accordance with Directive 2000/31/EC, Regulation (EU) 2022/2065 (DSA) and Book XII of the Belgian Code of Economic Law, the Publisher benefits from the limited liability regime applicable to intermediary service providers.
As soon as it has actual knowledge of manifestly unlawful content, the Publisher acts promptly to prevent access to it or to remove it, under the conditions set out below.
10.3 Reporting procedure (Article 16 DSA)
Any person (user, rights holder, third party) may report content they consider unlawful or contrary to their rights, by writing to youmiamiam@tuta.com with:
- precise identification of the reported content (URL of the share link where applicable);
- the identity and contact details of the reporting party, and where applicable their status as a rights holder or representative;
- a reasoned statement of the reasons why the content is considered unlawful or infringing;
- a good-faith declaration as to the accuracy of the report.
The Publisher acknowledges receipt of the report and responds within an indicative period of 48 to 72 working hours. Following the review, it may:
- remove the content or deactivate the share link concerned;
- request additional information;
- reject the report if it is manifestly unfounded, giving reasons for its decision.
10.4 Creators' right to object
Any content creator may ask the Publisher to block any future extraction of content of which they are the author, by sending a reasoned request to youmiamiam@tuta.com together with evidence of their status (links to the accounts or publications concerned). Once the request is validated, the Application blocks, as far as technically possible, any new extraction attempt from the identified sources.
10.5 Information for the user whose content is removed
Any user whose content is removed or made inaccessible receives a reasoned notification ("statement of reasons" within the meaning of Article 17 DSA) comprising:
- identification of the content concerned;
- the reasons for the removal and its basis;
- the remedies available (internal challenge to
youmiamiam@tuta.com, recourse to an out-of-court dispute settlement body, judicial recourse).
11. Premium subscriptions — Commercial terms
11.1 Offers and prices
The Publisher offers two Premium subscription plans: a monthly subscription and an annual subscription, both tacitly renewable at the end of each period.
The applicable price is the one displayed in the Application and on the purchase confirmation screen of the distribution platform (App Store or Google Play) at the time of subscription, in the currency of the user's platform account. No amount is due until the user has confirmed their purchase with the platform.
Prices are set per country or per currency zone, according to the price tiers offered by Apple and Google. They may differ from one country to another, including between countries sharing the same currency, due in particular to the available price tiers, exchange rates and locally applicable taxation.
In the European Union, and in any country whose regulations so require, displayed prices are inclusive of all taxes, at the rate applicable in the user's country of residence as determined by the platform. In other countries, taxes may be added at the time of payment, according to the platform's rules.
The subscription involves no activation fee, no cancellation fee and no minimum commitment period.
The Publisher may modify its prices for the future. A price change affecting an ongoing subscription is notified to the user at least 30 days before it takes effect, by email and/or by notification in the Application.
This notification is in addition to each platform's own mechanisms: Apple and Google directly inform the subscriber of any price increase and, in the cases provided for by their rules, require their express consent, failing which the subscription is not renewed at the new price.
The new price never applies to a period already paid for. The user may cancel free of charge before it takes effect, from the settings of their Apple or Google account.
11.2 Payment terms
Subscriptions are sold exclusively through the official platforms:
- Apple App Store (iOS), via the user's Apple account;
- Google Play Store (Android), via the user's Google account.
Apple and Google act as sellers and VAT collectors for these transactions. The payment, invoicing, refund and financial data protection terms are those of Apple and Google. The Publisher never has access to the user's banking information.
The technical management of subscriptions is provided on behalf of the Publisher by RevenueCat, Inc. (United States), a processor of the Publisher, which receives transaction notifications from Apple and Google in order to activate Premium status in the Application.
11.3 Tacit renewal
Subscriptions are tacitly renewed at the expiry of each period, unless previously deactivated by the user from the settings of their Apple or Google account. The renewal date and amount can be consulted at any time in those same settings.
11.4 Cancellation
The user may cancel their subscription at any time from the settings of their Apple or Google account. Cancellation takes effect at the end of the current subscription period; the user retains access to Premium features until that date.
Cancelling a subscription results in neither the deletion of the Account nor that of the recipes, which remain accessible within the limits of the Free tier.
11.5 Right of withdrawal and "digital content" exception
In accordance with Book VI of the Belgian Code of Economic Law (Articles VI.47 et seq.), the consumer in principle has a period of 14 days from the conclusion of the contract to withdraw, without giving reasons.
However, in accordance with Article VI.53, 13° of the Code of Economic Law, this right cannot be exercised for contracts for the supply of digital content not supplied on a tangible medium where:
- performance has begun with the prior express consent of the consumer, and
- the consumer has acknowledged losing their right of withdrawal once performance has begun.
On subscribing, the user must therefore explicitly tick the following declaration:
☐ I expressly request that performance of the Premium Service begin immediately, before the end of the 14-day withdrawal period. I acknowledge that I thereby lose my right of withdrawal.
If the user does not tick this box, Premium access is deferred by 14 days, during which period the right of withdrawal remains exercisable.
In practice, refund requests must be addressed directly to Apple or Google, the sole sellers of the subscription. The Publisher assists the user with this procedure on simple request to youmiamiam@tuta.com.
11.6 No paid trial period
The Application does not offer a paid trial period. The guest and Free modes serve as a trial period.
11.7 Complaints and dispute resolution
Any complaint may be addressed to youmiamiam@tuta.com. The Publisher undertakes to respond within 14 days.
In the event of a persistent disagreement, the consumer may have free recourse to the Service de Médiation pour le Consommateur:
Boulevard du Roi Albert II 8 boîte 1, 1000 Bruxelles contact@mediationconsommateur.be — www.mediationconsommateur.be
A consumer residing in another Member State may also contact the competent out-of-court dispute settlement body of their country, or the network of European Consumer Centres (ECC-Net).
The European Online Dispute Resolution (ODR) platform ceased to exist on 20 July 2025, Regulation (EU) No 524/2013 having been repealed by Regulation (EU) 2024/3228. It therefore no longer constitutes a means of recourse.
12. Warranties and limitation of liability
12.1 Legal warranty of conformity
The consumer benefits from the legal warranty of conformity provided for by Book VI of the Belgian Code of Economic Law and by Directive (EU) 2019/770 on the supply of digital content and services. No clause of these Terms may derogate from it.
12.2 Service provided "as is"
Subject to mandatory legal warranties, the Service is provided "as is" and the Publisher does not warrant:
- the accuracy, completeness or fidelity of recipes extracted by artificial intelligence tools;
- the absence of errors, omissions or inaccuracies in the ingredients, quantities, instructions or durations;
- the uninterrupted availability of the Service or its operation without anomaly;
- the compatibility of the Service with all devices, operating systems or configurations;
- the durability of support from the third-party platforms that are sources of content, whose evolution is independent of the Publisher's will.
12.3 Warning on allergies and intolerances
The user is solely responsible for checking the composition of recipes with regard to any allergies, intolerances, dietary restrictions or medical requirements. As recipes are generated automatically, they may contain errors or omissions, including regarding allergenic ingredients.
Always check the original recipe before any preparation.
The Publisher declines all liability for any damage resulting from the preparation or consumption of a recipe, except where such damage results from its wilful misconduct or gross negligence, and in any event without this clause being able to limit its liability in the event of harm to life or physical integrity.
12.4 Limitation of liability
Subject to the mandatory provisions protecting the consumer, the Publisher's liability is limited to direct and foreseeable damage resulting from a breach attributable to it, and is capped, per user and per calendar year, at the higher of:
- the sums actually paid by the user for the Service during the 12 months preceding the triggering event; and
- €100.
This limitation does not apply under any circumstances:
- in the event of wilful misconduct or gross negligence by the Publisher or its agents;
- in the event of non-performance of an obligation constituting a principal undertaking of the contract, except in cases of force majeure;
- in the event of harm to life or physical integrity;
- in all other cases where Belgian law prohibits such a limitation, in particular under Articles VI.83, 13° and 30° of the Code of Economic Law.
12.5 Data backup by the user
The Publisher implements regular, encrypted backups. The user is nevertheless invited to periodically export their recipes, in particular in guest mode, where the data is stored only locally.
12.6 Force majeure
The Publisher is not liable for the non-performance or late performance of its obligations resulting from a case of force majeure within the meaning of Belgian law.
13. Intellectual property
13.1 Publisher's property
The Application, its trademark, its domain name, its source code, its interface, its graphics, its texts and all its constituent elements (excluding User Content) are the exclusive property of the Publisher or its licensors. Any unauthorised reproduction, representation, modification or exploitation is prohibited.
13.2 Third-party trademarks
The names and trademarks of third-party platforms (YouTube, TikTok, Instagram, Facebook, etc.) that may be mentioned remain the exclusive property of their holders. No affiliation, partnership or endorsement is claimed.
13.3 Ownership of User Content
The user retains full intellectual property in their User Content, subject to the limited licence granted in Article 9.
14. Personal data
The processing of personal data is governed by the Privacy Policy, available in the Application and at https://youmiamiam.be/documents, which forms an integral part of these Terms.
In summary: the recipes and photos of users with an Account are hosted in France; the intermediate data derived from third-party content is deleted immediately after its technical use; email addresses and passwords are never shared or resold; no data is used to train artificial intelligence models.
15. Cookies and trackers
The mobile Application does not use cookies in the web sense, but technical local storage necessary for its operation.
Advertising trackers may only be activated in the context of viewing a rewarded advertising video requested by the user (AdMob), and subject to their consent collected via a consent management platform (CMP).
The youmiamiam.be website places no cookie or tracker that is not strictly necessary and integrates no third-party audience-measurement tool.
16. Residual risks and acceptance by the user
The user expressly acknowledges having been informed that:
- the extraction of recipes from content accessible on third-party platforms is done under their own responsibility;
- the lawfulness of such extraction may depend on the nature of the source content, the rights of its author and the terms of use of the source platform;
- use of the Application does not exempt them from respecting the rights of third parties;
- private copying is only one of the legal bases that may apply: depending on the circumstances, automated analysis processing may fall under other exceptions provided for by law. When invoked, private copying is subject to strict conditions (strictly personal use, no redistribution, no commercial purpose) and does not cover the sharing of a recipe by link (Article 8.3);
- automatically generated recipes may contain errors, including regarding allergenic ingredients (Article 12.3).
The Application makes no audio or video file available to the user. It does not allow the user to save, convert or download any media from a third-party source. The intermediate technical elements required for the analysis are neither returned to the user nor retained: only structured factual information is produced and stored.
17. Applicable law and competent jurisdiction
17.1 Applicable law
These Terms are governed by Belgian law. This designation does not deprive the consumer of the protection afforded to them by the mandatory provisions of the law of their country of habitual residence, in accordance with Article 6 of Regulation (EC) No 593/2008 (Rome I).
The Publisher voluntarily applies to all its users, whatever their country of residence, the protections provided for by Belgian and European consumer law, without prejudice to any more favourable mandatory provisions of the user's country of habitual residence.
17.2 Jurisdiction
In accordance with Articles 17 and 18 of Regulation (EU) No 1215/2012 (Brussels I bis), a consumer residing in a Member State of the European Union may, at their choice:
- bring proceedings before the Belgian courts of the Publisher's registered office, or
- bring proceedings before the courts of their Member State of residence.
The Publisher, for its part, may only bring proceedings before the courts of the consumer's Member State of residence.
For a consumer residing outside the European Union, the Belgian courts of the Publisher's registered office have jurisdiction, without prejudice to any mandatory jurisdiction rule of the country of their habitual residence.
For disputes between the Publisher and a user who does not have consumer status, the courts of the judicial district of Brabant wallon have exclusive jurisdiction.
18. Miscellaneous provisions
18.1 Partial invalidity
If a clause of these Terms is held to be void, unlawful or unenforceable, the other clauses remain in full force. The invalid clause is, as far as possible, replaced by a valid clause pursuing the parties' initial intention.
18.2 No waiver
The fact that the Publisher does not require the strict application of a clause does not constitute a waiver of that right.
18.3 Assignment
The user may not assign these Terms or the rights arising from them.
